Short-termed rentals – basis conditions

1 - the minimum time of the rental are 24h beginning with giving out the car, clause 1 the lessee declares that he receives the vehicle technically operational, without any damages of the vehicle body or interior, and he is obliged to return the vehicle in this condition. Any objections regarding technical condition of the vehicle should be recorded in the COMMENTS section of the rent agreement. Otherwise, any potential claims of the lessee will not be taken into account

2 - there can be a free tardiness of 60 minutes when giving back the car. The car rental has to be informed about it.

3 - an overtime of more than 1 hour causes a calculation of next 24h

4 - if you don't inform us about breaking the time of the contract, we will inform the police about car theft. Furthermore we raise the sum you have to pay for every additional 24h you are using the car on your own.

5 - giving out and giving back the car is free in the city

6 - giving out and giving back the car out of the city amount to:

• to...70km – 149.99 PLN + 22% VAT,
• more than 70km -  only on agreement

7 - the amount of the rental includes:

• insurance oc/aw/nw
• limited car service
• car equipment

8 - The vehicle used by the lessee has full OC (civil liability) insurance and insurance appropriate for vehicles intended for renting. The insurance is included in the vehicle rent price, nevertheless the lessee is financially responsible for any damages which are not covered by insurance liability of the Insurance Association. In the case of theft of the vehicle during the period for which the rent agreement is valid, the lessee shall be charged with the amount equal to 10% of the vehicle value, unless the vehicle was stolen from a safeguarded parking lot, for AC damage, the lessee shall be charged with the amount of his own contribution i.e. 20% of the vehicle damage value, regardless of the amount of compensation paid by the Insurance Association if the damage was caused by a fault of the lessee, Polandcars.com car rent firm has the right to keep the deposit at its full amount till the moment when the damaged car is repaired. The part of the deposit left after deduction of the costs of: the vehicle repair, formal costs connected with the repair and any potential penalties and fines, shall be returned. In the case of theft of the vehicle during the period for which the agreement is valid and refusal of compensation payment by the Insurance Association, the lessee shall cover the vehicle value including any additional costs connected with the vehicle (total repayment of leasing etc.)

9 - the customer gets the car filled up and is obligated to give the car back filled up, otherwise the customer has to pay the double amount of fuel according to the proce of the place where the car is given back

10 - the customer gets a clean car, there car can be given back dirty (don't switch it with damaged!), when the costs of the car wash are taken by the customer.

11 - in case of damage or loss of the car, independent of the responsible one, the customer has to pay 1.500.00 PLN of “participation”. In case of a minor damage the customer has to pay the amount. If the customer fullfills all conditions of formalities, the participation costs can be dropped.

12 - during the time of renting the car, the customer is obligated to check the technical state of the car, like oil level, tires etc. In case of technical defects the customer has to eliminate them.

13 - the car rental takes into consideration a possible setting of considering slight and necessary repairs. This happens only, if the bill of the garage is made out on PolandCars.com

14 - trips abroad are possible only after written authority on basis of our insurance OC and the green card

15 -in case of car theft or theft the police and car rental have to be informed immediately, alarm phone  0048 (0) 605 480 550, at any hour!

 

16 - if you have the possibility of parking the car in a guarded place at night, make use of it

17 - in the events of any attempt of replacing, substituting or disassembling any parts marked or having serial numbers, as well as attempts of tampering with the kilometre counter readout with the intention of suppressing actual mileage of the vehicle, the lessee shall be charged with the amount equal to the value of the parts basing on current retail prices, amount for assembly of these parts, and penalty at the level of PLN 10,000.00 (ten thousand zlotys)

18 - in the event of any breakdown of the vehicle covered by the factory protective period, the lessee is obliged to immediately notify an employee of PolandCars.com car rent firm and assistance of this fact, and with respect to vehicles after the manufacturer’s protective period, the customer shall repair any defects and faults at his own expense. Tel. numbers are available in AC policies and stickers on the vehicles. Any more serious defects resulting from proper utilization of the vehicle shall be repaired by PolandCars.com car rent firm on its own, while any defects which occurred as a result of improper utilization of the vehicle shall be charged to the lessee by PolandCars.com car rent firm

19 - by signing the rent agreement, the Lessee declares that he agrees to issuing of an inscribed invoice, without the requirement of placing his signature, for himself or his company or the company in which he works. He declares also that he is a person authorised to collect the invoice and sign statements of will on behalf of the company. In addition, he shall cover any costs connected with the invoice issued for him, for a bank, his company or also any other third party – including the company in which he works

20 - the lessee shall take over full responsibility for any damages caused by his fault (window breaking, tire fault which is not a consequence of any factory defects, damage of upholstery or other parts of the vehicle) The lessee authorises PolandCars.com car rent firm to charge him with any damage resulting from this and any potential parking fees, fines, vehicle towing costs, as well as other costs resulting from breaching of traffic regulations by the driver

21 - concerns the Rent Agreement for Business Vehicles: The parties state that they are entrepreneurs and that any potential disputes arising on the basis of this agreement shall be passed on for judgement of the Business Arbitration Court at ul. Œwiętego Mikołaja 4 in Wrocław

22 - any issues not covered by this agreement can be considered basing on the civil code regulations

23 - there is a urgent ban on driving to following countries: Russia, White Russia, Ukraine, Romania, Serbia and Montenegro, Bosnia and Herzegowina and Albania

24 - in case of driving with alcohol and/or drugs the customer is responsible for all payments of repairs, damages and trial

25 - in case of a collision caused by the customer or car theft, another car can be rented after paying several extra costs

26 - the car can be driven only by the person who signed the contract

27 - the customer will have to pay extra for loss of:
car documents = 800 PLN, car keys = 500 PLN

28 - the agreement was prepared in two identical copies, one for each of the parties
